I agree. Maybe there should not be any legal status associated with a
domain name, but there invariably has to be. If the Internet is actually
a superhighway (groan, I know) think of a domain name as a billboard.
Then someone driving down the highway sees a billboard for MCDONALDS.COM
and drives on in.. to find Burger King? 

This is probably the main reason why I would not go into the TLD
business and why the Internic is probably not making as much money as it
could.. these legal issues still have not been handled with.
