I agree. Think about this. The rougue registries are claiming "prior
use", but that use is essentially on 0.01% of the net because they
are not being served by the Root servers. In the trademark arena
prior use is tied to interstate & international commerce. I don't
believe their "prior use" qualifies.
I suppose I could run DNS on a box at my location, and have someone
in Hong Kong hit that box to resolve a TLD that I made up, and have
the same right to "prior use".
