Can someone OWN the rights to a top level domain? You can own a registry,
but can you won a top level domain? Or is this public property that must
be handled as such? And what is handled "as such"? This is issues that
the IAHC must decide on, and then I bet the courts will make the final
decision.
I personally believe that top level domains can not be owned; they are
a public resource. So your argument just doesn't make sense. However,
there is no clarity on the issue; if TLDs can be owned, then we have
to deal with all this prior use stuff. If not.... well that would be
nice, now wouldn't it?
