Sounds like a good idea that should definitely be formally proposed to IAHC.
However, getting all the controllers of ISO TLDs to agree to implement this
2nd might be tough, especially if for some reason Timothy's Machines (TM) or 
something similar already exists in a TLD.

However the scheme still isn't perfect. TMWEB did a small lookup of the
name Monolith in the trademark databases; there were dozens. In fact, there
were several national trademarks which differed only by industry. Does that
mean that people would have to be
   MONOLITHSTEEL.TM.US
   MONOLITHCHEMICALS.TM.US

(I don't know if those companies exist, just an example).
If so, the names get longer and longer, and I'm sure there are examples of
companies in at least similar business (like apogee.com, which does
compilers I believe, and apogee1.com, which does computer games) so the
names get even longer "APOGEECOMPUTERGAMESANDSIMULATIONS.TM.US" at the
point where they become useless and no one would bother advertising them.

The only solution I can see is FCFS of all .TM names given that your company
has a registered TM at that level that *contains* the .TM name you are
requesting. So the first APOGEE to come along woul get APOGEE.TM.US, the
next would have to settle with APOGEECOMPILERS.TM.US, etc.

Just my .02 cents on Vince's idea
