I believe that this may be the only way. If we can establish by
mutual agreement who the contracting authority is to be and ISOC seems
to be the likely choice. Then we can draw up a clear unambiguous
contract. for the operation of a registry
Contracts are legally binding documents that clearly spell out the
rights and obligations of all parties. They would also establish that
TLD registries are management and service organizations and do not own
the TLDs themselves. Each contract should have sections which clearly
layout the processes to be followed should disputes arise, including
assumed legal jurisdiction - which could be the state or country of
the winning bidder.
I leave it for the specification drafters to establish whether a
registry can handle one or more than one TLD. Contracts would be
awarded to the lowest cost, qualified bidders, which assumes that
whatever fees they charge would be high enough to cover costs and make
a profit,. but lower than any other bidders.
If only one bidder bid on a TLD then they can charge whatever they
want
The bidding process would be open and the specifications submitted and
drafted by a consensus of interested parties with IAHC consolidating
them into coherent text.
Since a legal organization needs to be the contracting authority I
propose that that be ISOC.
I propose that ISOC be paid a set annual fee by each winning bidder to
cover its costs in administering the contracts

You can't do this without a clearer process for arbitration and for
determining which iTLD should exist, and what goals they meet beyond
providing more choices for naming.
You also have to expect a lot of whining from people who've gone
forward with business plans however premature they may have been.
It needs to reflect the new internationalism we're all lauding.
Nice ideas however...
