To file for a trademark can take years - but once files - you can use
the mark - pending the normal process...
Allow a domain to be registered immediately (after whatever immediate
checks are available) on the understanding that if it does infringe on
something (Trademark, Intellectual property - etc) that it could be
removed - say within an investigative period of 60 days. The
onus is on the company asking for the name - if they are doing wrong
(knowingly or unknowingly) - they loose their domain.
Some companies will be caught - the majoritory however will be able to
proceed with buisness as desired.
