To mandate any of the economic aspects of SLDs is to impose, yet
again, business practice limitations on the new registries. This is
not only unfair, but would, as I've said, create an unfair trade
situation in that NSI has no such restrictions.
The fact that the IAHC cannot change NSI's operating procedure is
not relevant here, since they feel they can change the new registrys'
operating procedure. To create a new system that they feel is better,
while NSI continues in their current operational mode, creates a situation
of serious legal problems.
For that matter, if the IAHC implements even a single policy that has
even the slightest legal problem, they will most likely be deluged with
lawsuits over the issue. I don't envy the IAHC's position one little
bit for this very reason; they're treading on eggshells, and, unfortunately,
the current draft has them wearing combat boots.
