I don't think so. Needs change. We don't have to use GOV as a precedent.
It's not really an ITLD anyway.

If I remember correctly, that's in the draft - at least as a
recommendation. (Or perhaps it just recommends the creation
of the category.) Regardless, I agree. The same goes for MIL
and EDU.
We actually have a FED.US now, with significant users. I once tried
mailing a GOV SA about migrating there. I haven't received any
answer.
People are resistant to change - remember how some COM-users feel about
losing their domain? Fortunately, I think the American TLDs (GOV, EDU,
MIL) won't threaten to sue as long as we give them enough time.
There is a place for exclusive registration - the second level.
