Carl, do you actually think that if a company came along in a year
and said, "Hey, we had no idea that these domain names even existed,
much less were published on the web," that a judge would accept that?

The USPTO has a journal that they publish, no? Could such a journal
or web page be given such force of law? 

That journal, in fact, is just that - a published list. There is no
restriction on immediate use, nor should there be for domain names.
