Not so astonishing, I am not a lawyer, and was not issing a legal position.

This is all, I would agree streched pretty thin.

But as an Irish person I love analogies, even if they are thin.

As a rule however, if you see a fence and a tree and some land under the
tree, it would be a reasonable guess that the one who owns the land also
owns the tree.
