  I think that you make a very good point here.  If a registry does
not have a reasonable idea of weather it can make a profit in this
operation PRIOR to filing, than there is not point in doing so.  
If that is predicated on shared/non-shared TLD's, or some mix and
having some say so as to what those TLD's will be, than this 
whold experiment is going to falter at some point.  When it does
the possibility of law suites will be greatly be inhanced.  I would
not like to see that happen.  In addition ALL users will suffer
to a great degree, folks will lose their jobs, and the Internet 
will lose creditibility, which I doubt it could ever regain.
