The utility of such a strategy will depend upon many things,
including who the challenger lodges the complaint with. It's important to
note that the registrar is NOT one of the alternatives, in this case. That
is, the challenger doesn't lodge a complaint with the registrar, since the
registrar does not assert the ability to adjudicate the matter.
Hence, it's not clear that such 'gaming' will be particularly
advantageous.
In any event I believe that the current view from the legal beagles
is that this is not in any way likely to completely eliminate later
challenges, but rather to weaken their position, or to establish a basis for
(eventually) weakening it.

Of course not. Are you suggesting that one should have operated
according to a proposed rule, one year before it is proposed? I hope not.
Besides requiring prescience, it would have been performed in the absence of
any community basis (rule) for it.

It is good not to believe things not said or implied.
On the other hand, if there is something I HAVE said that you don't
believe, I'm unable to figure out what that is from your note.
Perhaps you'd like to rephrase the above? Along the way, you might
want to consider making it less personal. These sorts of discussions are
almost always easier to conduct when the participants avoid pointing at each
other, much less declaring the veracity of the other party.
