Hi All,
Well, if I want to take an ad in Byte Magazine, I DON"T have to wait 60
days and announce my intention to use the name NetComm in the ad.
I can take out a phone number and the directory service will take queries
for NetComm and I DON'T have to wait 60 days before they allow the listing
of NetComm.
I can ( and did) register the name NetComm as a DBA in Ireland, and hey, I
DIDN'T have to wait 60 days to open a bamk account under the name NetComm,
or to put an ad in an Irish/Any Country newspaper.
I can walk down to my printer and guess what, he will print cards that say
"NetComm" TODAY. I DON"T have to wait 60 days!. WOW!
I moved office recently, and they put up the name NetComm down stairs in
plain sight and I DIDN"T have to wait 60 days.
But I would imagine that if I did take out an ad in Byte and advertise
Modems for sale, then I would be sued for trademark infringement by Netcomm
in Australia. Hmmm, how can Publishers, Printers, Phone Companies, everyone
EXCEPT Internet Registries cope without a 60 wait before use of a name? I
guess that over the years that these type of situations have occured, they
didn't know the HUGE risks thay were taking.
I better tell my printer to find some way to signel intent to print
business cards with the name NetComm on them. After all, since I travel a a
lot, and Netcomm might breach trademark in some other country, he must be
trembling that he might be sued out of business for not doing all he could
to ensure that the rightful owner of the Netcomm trademark was protected.
How often ( all you trademark lawyers) has Byte been sued over trademark
issues? Cacn you tell us when you will be changing the policies of everyday
commerce to fit the current model of trade and business that this IAHC has
spawned?
Guess I will tell people that the old ways are best, that RFCs are ignored
by the IAHC and the Internet is a slow place to do business.
Simon..... you are correct re the relevant RFC. is the IAHC empowered in
some way to contradict existing INternet RFCs?
Kevin
who apologies for his "bad hair" day and that naughty word that offended
Perry and others. Good word though!
