No you don't.  The nameservers don't have to be functioning at all.  The
InterNIC lame delegation policy is not enforced at all.

No you don't.  You can give any name you'd like and the domain won't be cut
off until the bill isn't paid.  Even if you give the wrong contact, then
call up NSI and give them a valid credit card, they'll let you keep the
domain.  They won't even ask for new billing details.

Having to pay your bill is hardly a qualification.  For one thing,
"qualification" implies that you meet some requirement *before* the domain
is registered.  By this logic, when I buy bubblegum at the corner store, I
am "qualifying" for it by paying.

Again, not true.

There will be a small list of "internationally recognized trademarks" that
will be checked against.  This is no more difficult than checking a name to
see if it's already been registered by another party.

Again, this is a question for CORE, which will have members who are in
competition with one another, hence always on the lookout.  You can't
police this in advance, nor should you.

People do have differences of opinion all the time.  The way to deal with
that is to set up a mechanism for disputes.  This will be in CORE, overseen
by POC.
