Well, don't sign that check yet.  The waiver is on the application form
for prospective registrars.

You agree to it as an integral part of the application process, and I am
sure they aren't offering any alternative contract.

If you still can't get it, andi, I will happily capture and e-mail you
the appliucation form's text in its entirety.  I'm sure the gTLD folks
won't mind.
